Deadly Force Case Pursued to US Supreme Court

A State Trooper was involved in the fatal shooting of an individual who had displayed a weapon at a Boston hospital, leading the Boston Police Dept. to pursue that individual into Newton, MA. When confronting the individual in Newton, MA. the Trooper was caused to use deadly force. The Estate of the decedent filed suit in Federal District Court seeking damages. Our office was successful in dismissing the case by way of Summary Judgment in Federal District Court. After the Estate appealed to the First Circuit Court, our attorneys were successful in obtaining an affirmation of the dismissal in that Court. When the Estate filed a Petition for a Writ of Certiorari with the United States Supreme Court, our office was successful is opposing that Petition, which was denied by that Court.
